A company that was blamed for their role in exposing a mesothelioma victim to asbestos has decided to appeal the court’s ruling.

Simon Lowes was awarded $2.07 million last month in damages after contracting mesothelioma from playing in asbestos materials as a child. The company that was to blame for his disease, James Hardie, has decided to appeal this ruling, which Lowes admits to being “very disappointed” in.

Lowes, 42, developed mesothelioma after playing in asbestos waste that was dumped by James Hardie at the Castledare miniature railway site in Wilson in the 1970s. Back then, asbestos was legal in the U.S. and popularly used in construction materials.

The mineral is now currently banned after it was discovered that breathing in asbestos fibers can contribute to several illnesses, including mesothelioma. Mesothelioma is a form of cancer that affects the lining of the lungs, heart and chest cavities. It can take up to 50 years to manifest, so most victims never become aware of their illness until it is too late. Although there are several treatments for mesothelioma, including chemotherapy, radiation and surgery, there is currently no cure for the disease.

Lowes’ mesothelioma attorneys, Slater & Gordon, confirmed today that a subsidiary of James Hardie, Amaca, filed for an appeal of the ruling.

“Simon is very disappointed that James Hardie’s compensation fund (Amaca) has not accepted the umpire’s decision and instead are going to spend more time and money trying to avoid responsibility for his life-threatening cancer,” said Michael Magazanik, a mesothelioma lawyer for Lowes. “He hopes that the people in charge at the fund reconsider their position and accept that exposing him to a deadly toxin when he was a three-year-old was outrageous and that the judgment sum should be paid and everybody left to get on with their lives.”
